Refine Legal recognizes the importance of its visitors’ privacy and has therefore prepared this Privacy Policy to inform you about what information we collect about you and how we process it. Refine Legal reserves the right to amend this Privacy Policy from time to time, and we encourage you to periodically review its contents to stay informed of any such changes.

Being aware of the importance of your privacy, Refine Legal processes your personal data in accordance with the Personal Data Protection Act (“Official Gazette of RS”, no. 87/2018) (“PDPA“) and, where applicable, the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR“).

In order to clarify the provisions of this Privacy Policy, in this section you can find the meaning of certain terms used in the text of this Privacy Policy:

“Personal Data”

means any information relating to an identified or identifiable natural person, as defined by the PDPA and the GDPR.

“Sensitive Personal Data”

means special categories of personal data, including data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data, biometric data processed for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

“processing”

means any operation or set of operations which is performed on Personal Data, whether or not by automated means.

“Controller”

means the natural or legal person which, alone or jointly with others, determines the purposes and means of the processing of Personal Data.

“data subject”

means you, as an identified or identifiable natural person to whom the Personal Data relate.

Which Personal Data we process

Depending on how you use our website, we may collect and store different types of your Personal Data, such as your name and surname, e-mail address, phone number and data contained in documents you voluntarily submit to us (such as a CV), as described in detail for each relevant section below.

Submission of job applications on our website is intended solely for persons who are at least 18 years of age. By submitting any Personal Data through this website, you confirm that you are at least 18 years old. Refine Legal does not knowingly collect or process Personal Data of persons under the age of 18 and assumes no responsibility for any such data that may be submitted in breach of this requirement. If we become aware that Personal Data of a person under the age of 18 has been submitted, we will delete such data without undue delay.

Refine Legal does not intentionally process any Sensitive Personal Data through this website. If such data is inadvertently submitted or becomes necessary, Refine Legal will comply in all respects with the provisions of the PDPA and the GDPR relating to the special requirements for the processing of Sensitive Personal Data. We kindly ask you not to include Sensitive Personal Data in any communication or document (e.g., CV) submitted through this website.

How we process your data

Refine Legal collects your Personal Data from you directly, through the Careers page — job applications.

On our “Careers” page you may submit an application for a job opportunity with Refine Legal. To process your application, we collect the following information from you:

  • first name;
  • last name;
  • e-mail address;
  • phone number (optional);
  • curriculum vitae (CV) and any additional information you voluntarily include in, or attach to, your application (e.g., cover letter, references, portfolio).

Submission of an application is made on the basis of your explicit prior consent. If you do not provide us with the information marked as required, we will not be able to consider your application.

Purposes of Personal Data processing

We process your Personal Data for the purpose of processing, evaluating and administering your job application, communicating with you in the course of the selection procedure, and, if applicable, entering into pre-contractual steps with you.

What is the lawful basis for the processing of Personal Data

The lawful basis for the processing of Personal Data by Refine Legal in relation to the purposes set out in this Privacy Policy is consent of the data subject (your consent) in accordance with Article 12 para. 1 item 1) of the PDPA, i.e. Article 6(1)(a) of the GDPR.

You may withdraw your consent at any time, without affecting the lawfulness of processing carried out before such withdrawal. The withdrawal of consent can be done by sending a written request to the e-mail address specified in the “Controller of Personal Data” section above.

To whom your data are disclosed to

Your Personal Data may be disclosed to the following categories of recipients, to the extent necessary for the purposes set out in this Privacy Policy: IT service providers and hosting providers, providers of website and e-mail services, professional advisors (auditors, accountants, counsel), and competent authorities.

Beside the aforementioned persons, your Personal Data will not be revealed, forwarded, sent, transferred, disclosed or in any other manner made available to any other third parties. However, your Personal Data may be disclosed to competent authorities if such authorities request such data from us under their lawful and statutory competencies.

Your Personal Data will be stored on servers located in the European Union.

Where our website uses third-party analytical and marketing tools (such as Google Analytics and Microsoft Clarity), the providers of such tools (Google LLC and Microsoft Corporation) may process certain data (such as IP address, device and browsing information) on servers located in the United States of America. Transfers of Personal Data to such third countries are carried out on the basis of appropriate safeguards, in particular the Standard Contractual Clauses adopted by the European Commission and, with respect to transfers to the United States of America, the EU-U.S. Data Privacy Framework, where the relevant recipient is certified under that framework. How long do we keep your data

We retain your Personal Data only for as long as necessary to fulfil the purposes set out in this Privacy Policy, and, in any case, no longer than the duration of the selection procedure, unless you have given us separate explicit consent to retain your application in our talent pool for future opportunities.

What are your rights in relation to personal data processing

At any moment you are entitled to the following rights:

  1. Access to Personal Data

Upon your request, Refine Legal will provide information on whether it processes your Personal Data, including the purpose of processing, the recipients or categories of recipients to whom the Personal Data have been or will be disclosed, in particular recipients in third countries or international organizations, retention periods, the existence of the right to request rectification or erasure of Personal Data or restriction of processing of your Personal Data or to object to such processing, and the right to lodge a complaint with a supervisory authority, the source of the Personal Data if not collected directly from you, as well as access to, or a copy of, the Personal Data.

Refine Legal will, without undue delay and at the latest within 15 days from the receipt of your request, deliver the requested information in writing without charge. If your request is manifestly unfounded or excessive, in particular because of its repetitive character, we may charge a reasonable fee based on administrative costs or refuse to act on the request. We may also charge a reasonable fee based on administrative costs for any further copies of Personal Data requested.

Rectification of Personal Data

You have the right to have your inaccurate Personal Data rectified without undue delay. Taking into account the purposes of the processing, you also have the right to have incomplete Personal Data completed, including by means of providing a supplementary statement.

Erasure of Personal Data (right to be forgotten)

You have the right to request the erasure of your Personal Data at any time.

Refine Legal has an obligation to, without undue delay, erase your Personal Data upon your request if: (i) your Personal Data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; (ii) you have withdrawn consent on which the processing is based and there is no other legal ground for the processing; (iii) you object to the processing and there are no overriding legitimate grounds for the processing; (iv) your Personal Data have been unlawfully processed; (v) the Personal Data must be erased for compliance with a legal obligation; or (vi) the Personal Data have been collected in relation to the offer of information society services referred to in Article 16 of the PDPA and Article 8 of the GDPR.

Restriction of Personal Data processing

You have the right to request the restriction of processing of your Personal Data from Refine Legal if one of the following conditions is fulfilled: (i) you contest the accuracy of the Personal Data, for a period enabling us to verify the accuracy of the Personal Data; (ii) the processing is unlawful and you oppose the erasure of the Personal Data and request the restriction of their use instead; (iii) we no longer need the Personal Data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims; or (iv) you have objected to processing, pending the verification whether the legitimate grounds of Refine Legal override those made by you.

If the restriction ceases to apply, we will inform you about such cessation before the restriction ceases to apply.

4. Right to object to processing of Personal Data

If you consider it justified on grounds relating to your particular situation, you have the right to object to processing of your Personal Data carried out by Refine Legal, in accordance with the provisions of the PDPA and the GDPR.

At any moment, you have the right to object to the processing of your Personal Data for the purposes of direct marketing, including profiling, to the extent that it is related to such direct marketing. In that case, Refine Legal will no longer process your Personal Data for such purposes.

5. Personal data portability

You have the right to receive your Personal Data previously disclosed to us in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from us, if: (i) the processing is based on consent or on a contract; and (ii) the processing is carried out by automated means. This right includes the right to have your Personal Data transmitted directly to another controller by Refine Legal, where technically feasible.

Besides the aforementioned, you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. Refine Legal does not make decisions exclusively by automated means, including profiling.

Additionally, you have the right to lodge a complaint with the Commissioner for Information of Public Importance and Personal Data Protection if you consider that any of your rights have been violated, at the following address:
